Property rights

Property law, defined in an objective sense, represents a branch of civil law, i.e. a system of legal rules that regulate social relations between people regarding the direct economic exploitation of things.

In the subjective sense, it is a property right that authorizes its bearer to have certain things in his direct private power – full or limited and forbids all other civil law subjects to arbitrarily interfere with the exercise of that power.

Property rights can be classified as rights on one’s own thing (ownership) and someone else’s thing (other property rights).

The number of property rights is limited by regulation:

  • Right of ownership,
  • Right of easement,
  • Lien,
  • Right of property encumbrance,
  • Construction right.
